Background Information on the crime: Two Georgia teens facing charges of killing with a shot to the face,13-month old Antonio Santiago and shooting his mother in the leg will be tried as adults. Antonio Santiago's mother, Sherry West, states that she was pushing her baby in a stroller when 17-year-old De’Marquise Elkins and 15-year-old Dominique Lang walked up to Sherry West demanding money. When she said she had no money, De’Marquis Elkins took out a revolver and shot West in the arm and her baby in the face. Sherry West identified De’Marquise Elkins from a photo lineup of 24 mugshots. He was booked into the Glynn County jail. De’Marquis Elkins is also being charged with a robbery and shooting that occurred 10 days before the slaying of Antonio Santiago. District Attorney Jackie Johnson of the Brunswick Judicial Circuit released a statement Thursday, March 28 of 2013 that she would not seek the death penalty against either suspect because Georgia law doesn’t allow capital punishment for defendants charged with crimes committed before they became 18 years of age. The law does, however, allow that both teens be charged as adults. Elkins is now also charged with a second attempted robbery and shooting that happened 10 days before the baby was murdered. March 11, 2013, the date of the indictment, states that Elkins tried to rob a person identified as Wilfredo Calix-Flores, pointing a gun at him while demanding his cellphone and wallet. Forensic evidence reveals that Elkins shot Calix-Flores in the arm with the same caliber revolver used to kill the baby 10 days later, so states the indictment. Elkins is charged with attempted robbery and assault with a deadly weapon for that crime. Only three of Elkins relatives are being charged with crimes since they are accused of helping him after the murder which is aiding and abetting a known fugitive. Katrina Freeman, an aunt of Elkins told police investigators that Elkins was eating breakfast with her from 8:15 to 11:30 which covered the time of the murder. Apparently and allegedly, the police had questioned them and found them to be protecting Elkins by their silence or misdirrectives. Brunswick, Georgia police of the coastal port city released two 911 recordings from neighbors who sobbed and pleaded for help immediately after 13-month-old Antonio Santiago was shot in the head a few blocks from Sherry West's apartment. The two callers said they heard three gunshots and then saw West take her son out of his stroller, lay him on the ground and try to revive him using CPR. She had been walking home from the post office when accosted. De’Marquis (DEMARQUISE) Elkins is not a member of the NRA, but he shot a pale, white-looking baby Antonio Santiago, in his stroller. The mother, Sherry West, is very pale and white looking so Elkins probably assumed both were white. He did not use an assault rifle. He did not toss a Bushmaster in the backseat of a car.
